QUANT ALGORITHM TREE SYSTEM LTD | Israeli company number 517208377 | support@qats.us
Issued 21 October 2026. Effective date is the date recorded on publication after the release checks are completed. This document does not amend previously accepted transactions by itself.
Registered and notice address: Maurizio Vitale 3, Apartment 22, Tel Aviv-Yafo 6965101, Israel.
These Terms govern your QATS trader account, Evaluation purchases, initial simulated funded accounts, performance Rewards, refunds, verification, complaints, Friend referrals and certificates. QUANT ALGORITHM TREE SYSTEM LTD is the service provider and the sole contractual payer of Rewards. Buying an Evaluation buys a simulated assessment service, not a deposit, investment or allocation of live capital.
The funded and payout provisions are part of these Terms. Obligations concerning the promised funded offer and any activation payment apply from the relevant Evaluation purchase. Trading on a funded account and earning performance Rewards require separate acceptance of its completed Funded Account Schedule and the applicable Terms, followed by confirmed activation. Registration alone does not activate a funded account, authorise an activation charge or create a Reward.
Documents and recorded schedules
The Evaluation and Trading Rules remain a separately published document defining measurement and trading controls. The plan and instrument information, account conditions, published service conditions and any individually confirmed offer supply their identified parameters. The relevant version or snapshot is made available before commitment and retained with the order, account, referral or case. Any additional voluntary cancellation offer, service deadline or support target applies only if expressly published or individually confirmed; mandatory rights do not depend on such an offer. A link to a changeable page alone is not a substitute for the accepted record. Annex A identifies the relevant record categories.
The Privacy Policy explains personal-data processing, including verification and biometrics. The Cookies and Storage Policy governs browser storage and optional choices. These notices do not create a legal basis merely because you accept these Terms. Bot Builder Terms govern separately offered Bot Builder or API products. The Affiliate Partner Agreement and Marketing Standards govern commercial partners; an ordinary Friend invitation does not create that relationship.
QATS Integrations Terms govern an optional connection through QATS Trade, an authorised webhook, QATS Ticket, a QATS trading API key, Bybit Native or another expressly supported connected application. They supplement these Terms only for that connection and do not amend purchased plan parameters, turn simulated trading into real execution, or replace the separate agreement required by Section 13.8. For integration mechanics the accepted Integrations Terms apply; these Terms continue to govern paid-service remedies, Rewards, liability limits and disputes. Mandatory law prevails over both.
Mandatory law prevails. These Terms govern contractual rights, remedies and processes. An accepted order or account schedule supplies its identified commercial and account parameters; the identified Rules govern their measurement. A schedule cannot exclude a protection in these Terms merely by containing a conflicting value or general disclaimer. Any expressly agreed variation must identify the affected provision and remains subject to mandatory law and Section 25. Marketing and support statements do not unilaterally amend an accepted order; this does not exclude liability for a misleading statement or binding pre-contract representation. Earlier accepted agreements continue to govern their transactions unless validly amended under Section 25.
1Parties and acceptance
1.1"QATS", "we" and "us" mean QUANT ALGORITHM TREE SYSTEM LTD, Israeli company number 517208377. "You" means the natural person who registers a trader account and accepts an order.
1.2These Terms are for natural persons acting in their own name. An organisation requires a separately offered and expressly accepted business arrangement after the relevant verification. An individual registration does not create that arrangement.
1.3A partner account is a separate identity and session governed by the Affiliate Partner Agreement and Marketing Standards. Participation as a partner does not authorise trading or activate a trader account.
1.4The provisions relevant to public site use apply to that use to the extent permitted by law. Registration creates access subject to these Terms and the suspension and termination protections in section 26. Each purchase is a separate agreement for the selected plan, formed when QATS expressly accepts the order and confirms it by email or another durable means. A checkout acknowledgement or pending payment authorisation alone is not acceptance. Paid access begins after payment confirmation; checkout states when the paid period starts. An eligible zero-price order requires acceptance but no payment.
1.5QATS may refuse an order before acceptance for a supported eligibility, capacity, legal, payment or security reason. If an amount was captured for an order QATS refuses, it is reversed or refunded to the original means.
1.6Before you submit an order, checkout shows the plan, the account size, the billing type, the price, the pricing option and any later activation fee, the reset price, any discount applied and the total. You can correct the order before submitting it. The button that commits you to pay says so.
1.7QATS records your account identity, the relevant transaction or account, document and schedule IDs, versions and SHA-256 content hashes, the time the documents were presented, UTC acceptance time, document and interface language, the action being confirmed, required acknowledgments, user-agent information and the network address available to the service. The Privacy Policy governs this evidence. You may retain the published text and your transaction conditions and request a durable copy of your acceptance record. Registration, Evaluation purchase, funded activation, Friend programme participation and a payout request remain distinct actions. Reading the Privacy Policy is an acknowledgment of information, not consent to every processing purpose. Optional tracking, any separately required early-performance request and biometric consent remain separate. A new acceptance neither erases an earlier record nor waives existing rights.
1.8Each order stands on its own. Paying for a reset on one attempt changes nothing on another. A trader may hold several accounts up to the limit in section 8.
2Eligibility countries and age
2.1You must be at least 18 and legally able to contract, must use the account in your own name, and must be permitted to receive the service where you live and where you use it.
2.2QATS sells only in the countries on its published list of served countries. Other countries are not eligible. The list and the applicable restriction categories are available before checkout and the applicable version is referenced in your order. Restrictions reflect legal, sanctions, compliance and provider constraints and may change subject to section 2.4. The choice of Israeli law and courts does not itself make Israel or any other country an eligible market.
2.3Using a VPN or a proxy to hide a closed location is prohibited. Ordinary privacy or workplace VPN use, without concealment, is not a breach.
2.4You must give accurate and current name, location, contact and eligibility information and correct it promptly when it changes. A move to a closed country, a new sanctions measure or the loss of a lawful payment route can affect an active service. QATS then assesses whether a lawful alternative exists, and if none does it suspends or ends only the affected service and determines the remedy under the cancellation and refund provisions in Section 21 and mandatory law. Lawful earlier use does not become wrongful because the list later changes.
2.5One identity, and accounts under common control. One person holds one trader identity. Accounts, identities and exposure may be treated together where reliable evidence shows common control or coordinated use. A shared device, a shared address or a shared payment method is not by itself proof of anything. QATS explains a resulting restriction and offers review, except where that would compromise a lawful investigation.
2.6Eligibility, age, location, payment-authorisation and sanctions screening may occur as necessary at the relevant stage. Routine hosted identity verification is required before a Reward request and release, not as a standard prerequisite for an Evaluation purchase or initial funded activation. Additional proportionate evidence may be required earlier if law or a specific credible security or fraud concern requires it, with an explanation where lawful. Section 12 distinguishes identity, trading compliance and ownership of a payment destination.
2.7Sensitive identity, tax, bank and wallet-ownership evidence is submitted only through the hosted verification or payment provider or a secure QATS route expressly identified for that purpose. Ordinary email, chat, support tickets and messengers are not submission routes for those documents. Section 12 governs handling of misdirected sensitive material.
2.8An incomplete check may pause the affected service or payment where the check is genuinely required. QATS identifies missing information and a practicable correction route. Incomplete or inconclusive verification is not itself proof of fraud and does not erase a debt.
3Nature of the service
3.1Evaluation is simulated trading on reference data derived from real markets. Orders, fills, balances, profit and loss, margin, buying power, funding and fees in the interface are computed by the platform. Evaluation orders are not sent to any market. They create no ownership of any asset and no custody, brokerage, bank, deposit or investment account.
3.2The account size in a plan measures risk. It is not money you hold and gives you no claim to that amount. Your fee buys the service. It is not trading capital and not a deposit.
3.3Passing an Evaluation is an assessment outcome, not a Reward. No wages, investment return or cash profit share arises during Evaluation. The initial funded opportunity follows Section 13 and the specific offer accepted at purchase. Rewards arise only under Section 14 for an activated funded account.
3.4QATS does not give personalised financial, investment, tax or legal advice, does not execute real trades for you, and does not accept money from you to invest. Learning material and tools are educational and operational. Their availability is not a recommendation to trade and not a promise that an Evaluation will be passed.
3.5The dated instrument catalogue identifies each supported simulated contract, underlying reference and market-data venue. A simulated instrument referencing a metal, index or share does not confer ownership of that underlying asset or direct access to a stock or futures exchange. Data-source changes follow Sections 17 and 25. QATS must not choose a later feed merely to cancel a previously accepted profitable trade.
3.6The words funded, account size, capital allocation, profit split and payout must be read in context. Initial funded balances are simulated. A real monetary Reward may become due under Section 14; neither an Evaluation balance nor a funded nominal account size is money held for you.
3.7The description of the simulation does not assert a regulatory exemption, licence or endorsement. QATS must offer the service only where it may lawfully do so and must provide any legally required status disclosures before purchase. These Terms do not authorise an activity requiring a regulatory permission that has not been obtained and do not remove rights under applicable financial-services or consumer law.
4Plans rules and binding parameters
4.1QATS publishes its plans on the site. Each plan has a plan card that shows that plan's figures: the account size, the price and any reset price, the profit target, the maximum loss limit and how it is measured, the daily loss limit and what happens when it is reached, the minimum trading days, any consistency requirement, the instruments and leverage available, position limits, the number of evaluation steps, the pricing option and any activation fee, the billing type, and any trading or payout fee. The Evaluation and Trading Rules published on the site define how each figure is measured.
4.2Plan-specific figures are set out in the plan card and the Rules rather than repeated here. General limits expressly stated in these Terms also apply. The binding figures and measurement rules for your purchase are those presented before you commit to pay and recorded in the accepted order and snapshot. A later catalogue edit cannot supply a missing material condition or change an accepted one.
4.3Your parameters are fixed at purchase. QATS stores the plan card, rule version and applicable parameters against the trading account and makes the snapshot accessible in the trader area or supplies a durable copy on request. A later catalogue, plan-card or Rules change does not change an existing order except to the limited extent permitted by section 25.2.
4.4Plans are versioned. Each plan's rules carry a revision and a rule version identifier, with the period for which that revision is current. The order records which revision you bought.
4.5Different accepted plans may have different thresholds and consequences. The plan and Rules must identify whether a firm daily limit pauses trading or ends an attempt, how the maximum-loss floor moves and how steps are completed. A personal daily stop that merely pauses entries is distinguished from a firm hard breach. A dashboard label does not override the accepted rule or mandatory law.
4.6QATS may publish new plans and new prices at any time. A new plan or a new price applies to new purchases, not to an account you already hold.
5Orders prices and payment
5.1The offer and checkout show the full price, currency, mandatory taxes and unavoidable charges before you commit to pay. Prices are shown in US dollars unless another currency is stated or applicable law requires otherwise. Where Israeli consumer price-display requirements apply, QATS displays the legally required total price in New Israeli Shekels, unless a lawful exception applies; a USD label does not displace those requirements. Any permitted conversion, its basis and the final amount payable are disclosed before authorisation. Your bank or card issuer may impose its own separately disclosed charges. The receipt identifies the seller, order, currency and applicable tax.
5.2Card details are entered through the payment provider identified at checkout using its secure payment interface. Do not send full card details or a card security code to QATS support. QATS uses the transaction status, payment reference and permitted payment information to administer the order, as described in the Privacy Policy. Provider terms applicable to payment processing do not replace QATS's responsibility for the service you bought.
5.3Some plans offer a standard price with no funded activation fee and a lower initial price with a one-time funded activation fee. The plan card and accepted order state the selected option and the exact activation fee, if any; that amount is fixed for the order. An activation fee is charged only after a verified pass, acceptance of the funded and payout provisions in Sections 13 and 14, completion of required checks and a new payment authorisation by you. Passing alone does not authorise a charge. QATS must not introduce an activation fee into a plan sold without one.
5.4You authorise only the charges shown in the accepted order. A failed payment can prevent activation. A reversal can suspend the related service while it is investigated. QATS does not charge a penalty because you exercised a right with your payment provider, and may give the provider records of the authorisation and of the service delivered.
5.5A payment can be authorised, captured, settled, refunded or disputed at different times. QATS records these states separately. A pending authorisation alone does not establish order acceptance or completed payment. Acceptance and activation follow section 1.4. For a partial refund QATS identifies the original charge, the affected service and the amount.
5.6A declined payment grants no access. QATS may limit repeated failed attempts, require another permitted method, or hold an account where there are signs of account takeover. An ordinary decline is not evidence of fraud.
5.7QATS corrects a manifest pricing or processing error before acceptance. After acceptance it either performs the bargain you paid for or, if that is impossible, refunds in full. It does not raise the price of an accepted order.
6Discounts promotion codes and credits
6.1Discounts and promotions form part of the offer you accept. Checkout shows the binding discount and records it in your order. Future offers may differ, subject to existing customer entitlements under the applicable programme terms and this section.
6.2A plan card may show a genuine previous price and a saving alongside the current price. Price comparisons must be accurate and comply with applicable law. QATS may change the offer for future purchases without changing an accepted order.
6.3A promotion code has disclosed eligibility conditions, a discount percentage, validity times, total and per-customer usage limits, and eligible products. It applies in the sequence in section 6.8. Checkout explains if a code is expired, exhausted, ineligible or already used and shows its effect before acceptance. Undisclosed restrictions do not apply to an accepted order.
6.4A partner-owned promotion code is separate from referral attribution. Using it does not create, replace or extend your referral attribution. Partner commissions are governed by the Affiliate Partner Agreement and Marketing Standards and do not add a charge to your purchase. Partner remuneration disputes do not change your accepted price or remove an otherwise valid customer discount.
6.5A 100% promotion code makes the eligible purchase free. A zero-paid purchase earns no partner commission and has no monetary purchase price to refund. This does not remove any other contractual or mandatory remedy for non-delivery or defective service.
6.6A valid partner attribution may give you the customer discount recorded at registration, with no fixed expiry while attribution remains valid. The attribution precedence in Section 15.3 applies. Later links and checkout promotion codes do not replace it. Correction or detachment requires a documented error, substantiated abuse or invalid attribution, a legal requirement or your documented request, with reasons and review where lawful. Termination of the partner alone does not cancel your existing discount. Lawful detachment affects future purchases after notice and does not rewrite accepted orders.
6.7Section 15 governs the Friend first-purchase discount and the separate Inviter reward. Partner and Friend referral attribution are mutually exclusive. A partner-attributed trader may earn an Inviter reward by inviting others, but cannot also receive the Friend first-purchase discount. Only one Inviter reward may be used on an eligible purchase.
6.8Checkout starts from the current eligible plan price, including any public plan price reduction. Where permitted by the applicable programme, it applies the partner customer discount, then one Inviter reward, then a promotion code, each to the remaining eligible price. For a Friend-attributed eligible first purchase, the Friend discount applies instead of a partner customer discount, with further combinations governed by the Friend referral provisions in Section 15. Checkout shows each reduction and the final total. No combination reduces the price below zero.
6.9A reset credit exists only if expressly included in the accepted offer. It is tied to its disclosed eligible service, cannot be transferred and has no cash value. QATS records its issuance, reservation, use and any valid reversal. A one-time Evaluation or renewal does not imply a free reset.
6.10Discounts and service credits are not cash, cannot be withdrawn, sold or exchanged for cash except where law requires, and are distinct from a Reward under the funded and payout provisions in Sections 13 and 14. A refund returns the amount actually paid under the cancellation and refund provisions in Section 21. A valid credit or Inviter reward used on a cancelled purchase is restored as required by its programme terms, unless the underlying entitlement was itself validly reversed. Where QATS's failure prevented timely use, the restoration provides a reasonable opportunity to use it. A cash refund owed is not replaced by credit without your agreement.
6.11QATS may change promotions for future purchases subject to the published offer terms. It must preserve discounts already applied to accepted orders and valid accrued benefits for their recorded validity period. It may not impose an undisclosed condition or internal threshold on a compliant order.
7Duration renewals and resets
7.1A plan has the billing type and service period disclosed at checkout. A one-time purchase creates no subscription. If a monthly option is offered, renewal requires your action and payment unless a recurring mandate is separately offered and expressly accepted with the amount, interval, next charge and cancellation route. You may cancel a recurring mandate through that route before the disclosed next-charge cut-off; the confirmation states when future charges stop. Cancellation of future billing does not itself end an already paid service period. Silence does not authorise another charge or conversion of a manual purchase into a recurring one. A request to cancel the service itself is assessed separately under Section 21, including Section 21.17 for an applicable Israeli continuing transaction. A billing cut-off or prepaid period does not postpone a mandatory cancellation date.
7.2If a paid period ends without renewal, QATS may close open simulated positions under the session rules and stop new trading after any grace period shown on the plan card. The trader area shows the cut-off and the renewal terms. An account that is not renewed is closed after the period stated on the plan card.
7.3A one-time plan buys a single attempt under the published failure, inactivity and termination rules. It does not buy permanent access to an unchanging platform, and no subscription is added to it without a separate purchase.
7.4A reset is a separate optional purchase that closes the affected attempt and starts a new one under the recorded plan version. It does not erase account or payment history and never triggers an automatic charge. A renewal of the same account preserves its existing trading parameters. A reset also preserves the applicable parameters unless a different plan and its terms are clearly offered and expressly accepted. A renewal or reset does not waive a pending complaint or a remedy for the previous attempt.
7.5Reset availability, the window following a breach and any relationship to the remaining paid period are stated in the accepted plan snapshot. No reset right is implied for funded accounts. Evaluation reset rules do not govern a future live exchange arrangement. A reset option cannot be used to deny a remedy for a platform error.
7.6A pass verified for events inside a paid period is not lost because the review finished after the period ended. You may ask for the timestamps that decide whether an event fell inside the period.
8Accounts credentials and security
8.1The trader area, the trading interface and any API credentials are issued to you and must not be sold, lent, shared or operated by anyone else. Keep your credentials and any second factor secure and tell support@qats.us promptly if you suspect they are compromised. QATS may disable a session, rotate credentials and require re-verification to protect the account.
8.2A general platform limit on simultaneously active trading accounts applies where shown before an order. The applicable limit is retained with the order; it is not an additional purchase entitlement or a promise that every requested account will be accepted. QATS cannot retrospectively reduce an existing accepted entitlement through an unpublished limit. Attempts, steps, closed accounts and resets are counted as disclosed in the purchase flow.
8.3Activity recorded against your credentials is evidence, not an admission that cannot be answered. QATS weighs logs, device and session events, your report and the circumstances before deciding responsibility for a disputed action. You are responsible for loss caused by your own deliberate or negligent disclosure, to the extent the law allows. QATS is responsible for its own failure to apply reasonable security.
8.4A report of suspected compromise triggers a recorded response with a timestamp and proportionate steps to secure affected sessions and restore legitimate access. Where an unauthorised simulated order can be traced to a QATS failure, the correction follows section 19. Where you knowingly let someone else trade, the prohibition on sharing applies.
8.5Supported platforms, feeds and instruments depend on venue availability and provider conditions. QATS will name material dependencies and will provide a reasonable substitute or the remedy in section 19 where a paid plan cannot be performed substantially as agreed. Maintenance and urgent security downtime are communicated through the status channel or the trader area.
8.6An optional third-party connection requires the applicable connection presentation and affirmative acceptance before a new access grant is issued. QATS identifies the account and scope. You use your own permitted external account and comply with its terms and applicable data rights. Your acceptance does not confer a licence from the external provider or excuse QATS from obtaining permissions it needs. QATS may restrict or withdraw a channel for a substantiated legal, provider, security or operational reason under Sections 17 to 21, 25 and 26; it preserves lawful alternative access where reasonably available and remedies for material non-delivery.
9Evaluation outcomes
9.1How your Evaluation is measured is set by your plan card and the Rules, as recorded in your snapshot. This section describes only how outcomes are decided and reviewed.
9.2A plan has the number of Evaluation steps shown in its accepted snapshot. Advancement requires the published conditions for the current step, including any required review. The next step begins on the fresh balance and parameters disclosed for that step. An attempt is complete only when its final required step is verified as passed.
9.3A target is met only when the relevant positions and pending orders are closed, the minimum trading days and any consistency requirement are satisfied, the recorded costs are included, and no unrepaired breach remains. QATS then performs a recorded review. A provisional notice in the interface is not the final result, and QATS may correct a demonstrated error with an explanation and the relevant records.
9.4QATS does not use unpublished profitability, timing or style criteria to invalidate an Evaluation that complied with the published rules.
9.5A validated breach of a numerical limit has the effect stated on your plan card, even if it was accidental. A warning does not restore a failed attempt unless the data or the calculation was wrong. Where the plan says the daily loss limit only closes positions and pauses new orders, reaching it does not fail the attempt.
9.6A day, a session and a timezone are determined by the market and the plan, not by your browser clock. Events at a session close, a maintenance gap or a clock change follow the published server ordering. QATS keeps the contemporaneous marks and instrument specifications needed to reproduce a challenged result.
9.7Where an accepted order gave no clear answer to a material timing or rounding question, QATS resolves it fairly, explains the resolution and publishes the rule for future orders. It does not apply an undisclosed unfavourable answer to a past event.
10Trading integrity and prohibited conduct
10.1Trading must be your own genuine use of the simulation, including any automation the plan permits. The following are prohibited where they matter to a result or to security: knowingly exploiting frozen, stale or plainly wrong prices; forcing fills that could not occur under the published simulation; deliberate latency or queue manipulation; artificial volume; coordinated offsetting or mirrored accounts used to remove risk and obtain a pass; false identities; shared credentials; evading plan limits or a closed location; interfering with the platform or a provider; knowingly submitting forged documents, materially falsified evidence or knowingly false statements to obtain a pass, refund or Reward or to dispute a payment; and unlawful conduct.
10.2A strategy that performs well, short holding periods, common market ideas and a shared household are not, by themselves, evidence of abuse. Where a category of strategy is not allowed, QATS publishes an understandable description before applying it.
10.3Whether you may hold opposing positions across your own trading accounts is a plan setting disclosed before purchase. Permission to hedge does not authorise coordinated abuse or manipulation described in section 10.1. Permitted hedging is not itself evidence of misconduct.
10.4Automation stays within the instrument, exposure, order-rate and API limits published for your plan. You must be able to stop your own automation and must not route around a protective rejection through another interface. QATS may revoke a compromised token, reject excessive requests or stop activity to contain demonstrable harm. Approval of a tool is not approval of later conduct that breaks a published rule.
10.5QATS may refuse an individual order, correct an objectively wrong fill, exclude affected trades, impose necessary prospective protective limits, suspend an affected account or declare an attempt unsuccessful where the evidence supports the action and the response is proportionate. Changes to purchased parameters remain subject to Section 25.2. QATS keeps the pre-correction ledger, feed identifiers, rule version, timestamps and reviewer reasoning. Sections 18 and 19 govern investigation and correction; Section 20 governs complaints and independent review.
10.6QATS will not void every unrelated completed account, every earlier approved Reward or an otherwise valid refund because one attempt is questioned. Serious coordinated fraud may justify action on linked accounts on separately documented grounds.
10.7Correcting an objectively wrong fill does not require proof of intent. A finding of misconduct does require evidence of it. An adverse decision states the conduct category and the affected transactions clearly enough to be challenged, while QATS may keep exact detection thresholds confidential.
10.8You must not buy or sell a service that completes someone else's Evaluation, rent or transfer a passed account, or rotate identities to evade published limits.
11Simulated trading and risk disclosure
11.1Evaluation and initial funded trading are simulations. Orders, fills, balances, margin, buying power, commissions, funding and profit or loss are generated or calculated by the platform using reference data and the disclosed simulation model. No order is executed in a real market on your behalf under these Terms.
11.2Liquidity, queue position, spread, slippage, market impact, gaps, funding and latency may be approximated. A displayed quote or historical fill does not promise that the same transaction could occur in a live market, at the same price, size or time. A liquid reference venue does not guarantee continuous platform access.
11.3Leverage amplifies simulated gains and losses and can quickly cause a rule breach. Stops and protective orders are subject to the published fill model and gaps; a stop price is not a guaranteed fill. Personal risk controls do not replace firm limits. Fees and funding affect performance and qualification even when the displayed account balance is virtual.
11.4You may lose the fee paid for a properly supplied unsuccessful attempt. Repeated purchases can create significant actual expenditure. Simulated trading losses alone do not create a debt for the virtual loss or require you to replenish the nominal balance. Proven payment fraud, duplicate transfers and other independent legal liabilities are assessed separately.
11.5Past, hypothetical, backtested, certified or selected performance does not predict future results, establish typical earnings or guarantee a Reward. No live-capital transition is promised by a simulation label or certificate. A separate real-money product requires the disclosures and agreement described in Section 13.8.
11.6Before purchase and funded activation, QATS presents a clear simulation and risk summary with any separately required acknowledgment. The same essential distinction remains visible in the trading interface. Risk acknowledgment does not waive a refund, a valid Reward, reasonable-care obligations or any mandatory right.
12Identity sanctions and payment verification
12.1QATS distinguishes basic eligibility screening, hosted identity verification, trading-rule review and verification of a payment destination. Routine hosted identity verification becomes available after an active funded account has eligible performance and must be completed before a Reward request and release. QATS does not routinely require that hosted step at Evaluation purchase or initial funded activation. Necessary earlier legal or specific security checks remain subject to Section 2.6.
12.2The hosted identity workflow uses Didit or a replacement provider identified before the session. The Privacy Policy and session notice describe the configured document, facial comparison, liveness and authenticity checks, data recipients, retention and rights. Acceptance of these Terms is not biometric consent. Where separate explicit consent or an alternative route is required, it is addressed before the relevant processing. Withdrawal of consent does not by itself erase an established payment claim; QATS assesses lawful verification alternatives and payment restrictions.
12.3You must provide accurate information and promptly correct material changes. Reasonable evidence may include legal name, date of birth, residence, government ID through the hosted route, and tax or payee details where genuinely necessary. QATS explains additional evidence categories, offers a reasonable response period and considers accessibility or document-availability difficulties. A transliteration difference, expired document, shared household or inconclusive score is not automatically fraud.
12.4Identity documents, selfies, bank statements, tax forms and wallet evidence must use the named secure route. Never supply a card security code, bank login, seed phrase or wallet private key. Misdirected sensitive files are not accepted as verification submissions; QATS restricts access, directs you to the secure route and arranges secure deletion unless a legal preservation duty requires limited retention. A support channel may receive a complaint and non-sensitive explanation without receiving the underlying sensitive files.
12.5A successful identity check confirms only the checks performed at that time. It does not prove compliance with trading rules, entitlement to a Reward, tax status or ownership of a bank account or wallet. QATS reviews those matters independently and may refresh a stale or revoked verification before payment.
12.6A possible sanctions match is reviewed against relevant identifiers and the restriction actually applicable to the person, location, entity and payment route. A commercial country restriction is not described as a statutory sanction. A legal transfer block may require a scoped hold and reporting; it does not transfer the blocked amount to QATS for its own benefit. No alternative rail may be used to evade the restriction.
12.7Payment ordinarily goes to a destination demonstrably controlled by the verified trader. QATS may request account-holder confirmation, a signed wallet challenge or other proportionate evidence through the secure route. A third-party beneficiary requires a specific lawful exception, verified authority and written approval. An estate or legal representative may establish lawful settlement rights but may not operate the personal trading account.
12.8Destination changes require authenticated confirmation and any proportionate additional security check. Before a crypto transfer, QATS shows the asset, network, address, conversion basis and known fees. A transfer to a wrong address confirmed by you may be irreversible; QATS remains responsible for its own misdirection under these Terms and law. QATS never requests a private key.
12.9An incomplete check is marked awaiting information, with the missing category, secure route, effect and next review date where lawful. A refusal states whether the reason is eligibility, legal prohibition or substantiated misconduct. Non-response alone is not fraud or forfeiture of an approved debt. Holds are proportionate, periodically reviewed and open to the independent review in Section 20.
12.10Privacy rights, confidentiality, retention and lawful disclosures remain governed by the Privacy Policy and applicable law. Verification material is not used for advertising. A contract term does not substitute for a lawful basis for processing or a separate consent required by law.
13Funded accounts and activation
13.1After verified passage, QATS supplies the initial simulated funded opportunity described with your accepted Evaluation, subject to the disclosed eligibility and rule conditions. It cannot add an undisclosed performance test. Any delivery deadline expressly stated in the accepted offer is binding. Otherwise QATS must supply the opportunity without undue delay, identify a material delay and give an expected delivery date. If it cannot supply the promised opportunity for its own capacity or operational reasons, you may accept a suitable no-cost alternative or receive the affected Evaluation fee refund under Section 21.
13.2Before activation, you receive the completed Funded Account Schedule: account identity, simulated starting size, instruments, adopted Rules and funded risk controls, fees, payout parameters, service and inactivity conditions, any expressly agreed activation deadline and the activation fee fixed by the Evaluation offer. An offer expiry applies only if disclosed before acceptance; no undisclosed expiry forfeits the promised opportunity. Evaluation figures apply to the funded stage only where the schedule expressly adopts the identified rule. Missing material parameters must be completed and accepted before activation; they cannot later be invented to refuse a Reward. The funded offer must honour the material funded benefits promised with the Evaluation purchase.
13.3You separately affirm acceptance of these Terms as applicable to the funded account, including Sections 13 and 14, and its Funded Account Schedule. QATS records the versions and acceptance under Section 1.7. Any activation fee requires fresh authorisation and confirmed payment. QATS then supplies durable confirmation identifying the account, its simulated status, usable access and activation time. Registration or a provisional pass alone is insufficient. Acceptance at activation does not surrender a right already arising from the Evaluation purchase. If a captured activation fee does not result in usable access within the accepted delivery period, Sections 19 and 21 apply.
13.4Routine hosted KYC is required at the payout stage under Section 12. A failed or missing routine hosted check does not by itself add a pre-activation condition. A separate legal, sanctions or credible security issue is assessed on its own grounds and communicated where lawful. If QATS captures an activation fee but cannot provide the accepted account, Section 21 governs the refund.
13.5The funded account is a personal simulated service. Nominal size, Balance and Equity are accounting measures, not client property, deposited capital or a brokerage withdrawal entitlement. Negative simulated performance alone does not make you liable to QATS for the virtual loss. QATS is the sole debtor for a Reward properly earned under Section 14.
13.6You act independently and cannot bind QATS. These Terms do not create employment, agency, partnership, fiduciary authority or a mandate to manage customer money. Mandatory classification follows the actual facts and law. You are responsible for personal tax reporting; QATS performs required withholding and reporting and explains genuinely necessary tax documents and their secure route.
13.7QATS may lawfully analyse simulation data and make its own proprietary decisions, subject to the Privacy Policy and Section 22. QATS need not execute your simulated orders. Its independent trading profits or losses do not change the agreed Reward formula or transfer ownership of your independent strategy or code.
13.8A later live-capital, mirrored-trading or user-owned exchange connection requires a separate specific offer identifying the legal entity, account ownership, authority, real-money risks, compensation, permissions and applicable regulation, followed by express acceptance before activation. These Terms do not create that mandate, permit undisclosed API access or authorise conversion of an existing simulated account into a live account.
13.9Each funded account retains its own schedule and record. Scaling, a market change, consolidation of accounts or a stage transition requires disclosure of its effects on risk, payout cycles and existing claims and express acceptance where material. A transition does not erase already earned or approved Rewards or impose an unpublished aggregate cap.
14Rewards calculation requests and payment
14.1A Reward is contractual compensation paid by QATS for objectively qualifying simulated performance under an activated funded account. It is not a withdrawal of exchange trading profit, the nominal account size or the virtual balance. A positive simulated balance, an eligibility indicator or a submitted request alone is not payment approval. QATS verifies the accepted trading and payout conditions, identity, destination and any substantiated hold; it may reject or correct only the affected amount on a reasoned basis under Sections 14.14, 14.15 and 20. Once a compliant amount is approved, it is a debt owed by QATS, not a discretionary gift. QATS must not avoid a valid claim by failing to review it.
14.2The Funded Account Schedule and retained payout-page version state the profit basis, trader share, qualifying-day rules, consistency requirement, cycle target, first-request delay, interval, minimum, caps by cycle, protected balance, any profit-release fraction, fees and their payer, currency, rounding, account-debit method and effect on the maximum-loss floor. Disabled or inapplicable conditions are identified as such. A material missing condition cannot be supplied by a private policy or a later web edit. The schedule also identifies the precise event that changes or locks the floor, such as submission, approval or payment, and whether and how that effect is reversed following rejection or cancellation.
14.3Closed simulated net profit is the realised gains less realised losses, applicable calculated trade commissions and funding, with supported corrections allocated to the relevant session. For example, USD 1,000 of realised gains less USD 20 in calculated trade commissions, with no other losses or funding, gives USD 980 of closed simulated net profit before payout eligibility and the trader share are applied. Open-position or other unrealised profit is excluded unless an expressly accepted rule identifies a different basis. Profit already paid or reserved in a prior cycle cannot be requested again, and any accepted daily-profit capacity affects the qualifying measure as stated in the Rules without deleting ledger profit. A qualifying day uses the disclosed market session and the required measure, such as any qualifying trade or net closed profit reaching a stated threshold. Multiple trades do not multiply a day. Trade corrections are applied to the original session; shared timing or a profitable strategy alone is not misconduct.
14.4The available gross request is the lowest applicable ceiling disclosed for the account: the cycle cap; the specified fraction of its eligible profit basis, rounded down to the account precision; Balance minus the protected balance; or Balance minus both the current loss floor and the required retained risk margin. Each ceiling is no less than zero. Only enabled, accepted ceilings apply. If none applies, retained eligible profit is the ceiling. The separate gross minimum, eligibility conditions and post-debit floor test in Section 14.6 must also be satisfied; the displayed ceiling is not a guarantee that a request for that full amount will pass the floor test. A cap applies per request or cycle as expressly stated, not as an undisclosed lifetime limit.
14.5The standard trader share for newly offered QATS plans is 80% of an approved gross performance request derived from closed simulated net profit after calculated trading commissions and funding, but before separately disclosed payout transfer fees and required tax withholding; QATS retains the remaining 20% of that request. The exact share is displayed before purchase and in the accepted Funded Account Schedule. An account already sold with a different recorded share keeps that share unless the trader expressly accepts a valid prospective change; publishing this edition does not reduce an existing entitlement. Trade commissions already reflected in closed net profit are not deducted again when applying the split. For a gross request G, the trader amount before payout fees and tax is G multiplied by the accepted trader share, rounded down to the account precision; the remaining part of G is QATS's share. For example, an approved USD 1,000 gross request at an 80% share yields USD 800 for the trader before disclosed fees and withholding and USD 200 for QATS. The 80% rate does not mean that all positive simulated profit is immediately eligible: the accepted qualifying conditions, release fraction, caps, minimum and protected-balance and loss-floor tests in Sections 14.2, 14.4 and 14.6 determine the permitted gross request. Fees are deducted only from the share allocated to pay them by the accepted schedule, without making that share negative or transferring an excess fee to the other party without agreement. A request whose disclosed fees consume the entire trader amount cannot proceed; the screen explains the available amount or payment-method alternatives. Required tax withholding is separately itemised. The request screen distinguishes the gross performance amount, each share, fees, known withholding, expected remittance and simulated account debit.
14.6The simulated account debit is either the gross request or the trader amount after the allocated payout fees, as expressly stated in the accepted account-debit rule. Tax withholding and settlement-currency conversion do not silently change that simulated deduction. Before submission, the screen shows Balance, the debit, resulting Balance, the applicable post-request loss floor and remaining risk. Resulting Balance must remain strictly above that floor. Any floor lock or change triggered by the request must have been disclosed at activation. A generic payout label does not authorise an undisclosed change to the floor. The pre-submission calculation uses the floor resulting from the accepted trigger and reversibility rule, not merely the current displayed floor. Illustration only: if Balance exceeds that resulting floor by USD 100.00 and precision is USD 0.01, the greatest debit satisfying the strict floor test is USD 99.99, before any stricter accepted buffer or cap. This is a debit limit, not necessarily the gross request limit.
14.7Account amounts are calculated in integer minor units: cents for a USD account, not whole dollars. A fractional minor unit in the gross ceiling or trader share is rounded down; the residual of the gross split belongs to QATS's share. The settlement currency, its precision, conversion-rate source, fixing time, spread and known network or intermediary charges are disclosed before transfer authorisation. USD and USDT are not guaranteed to be interchangeable at a fixed rate. No undisclosed QATS charge or deduction applies.
14.8Before submission, close positions and pending orders where required by the accepted payout rules. The authenticated request identifies the funded account, its rule and schedule versions, amount and verified destination, and records the calculation and declarations shown. Identity and sanctions verification and secure destination setup must be complete. If your account or quote changes before submission, QATS provides the updated calculation for confirmation instead of silently changing the amount.
14.9An accepted submission immediately reserves the disclosed simulated debit once. Only one unresolved payout request may be open for that trading account at a time. QATS retains the original and post-reservation states and shows whether trading remains available or is paused under the accepted account rules. Submitting a request does not itself freeze trading. Later permitted activity does not rewrite the submitted calculation; it is assessed separately unless evidence shows that the original claim was itself invalid. Any effect on cycle counters at reservation is provisional until resolution. Repeating a submission after a timeout does not authorise a second reserve for the same request. The reservation reduces the actual Balance and Equity available for subsequent risk checks by the recorded debit. It is accounted for as a non-trading movement under the accepted measurement method so it does not itself create trading loss, a qualifying day or a new profit high. It does not reset the daily allowance or lower a firm loss floor unless that specific payout adjustment was expressly accepted.
14.10Review, approval, sending and settlement are distinct events. A request under review is still being checked. Approval validates the amount. The status displayed as ‘Funds sent’ or ‘paid’ records that finance confirmed a transfer instruction and its reference; it does not by itself prove that the recipient’s bank or wallet has finally credited the funds. QATS reconciles the resulting transfer outcome and remains responsible for an approved amount that is not delivered. A dashboard action does not repeat the simulated account debit. A non-trading reserve or release must not itself be treated as a losing trading day or a new profit event.
14.11You may ask to withdraw a request before approval. After approval, cancellation requires confirmation that no transfer has been initiated and agreement on the treatment of the existing claim. A valid rejection or cancellation releases the reservation once and reconciles the corresponding cycle, qualifying-day and floor state, taking account of any intervening trading without creating artificial profit or duplicate eligibility. A failed transfer of an approved Reward does not extinguish the debt or require you to earn it again. Any technical balance restoration on transfer failure remains reconciled to that debt so the same profit cannot support a second payment. QATS provides a retry or other lawful settlement route.
14.12QATS reviews complete requests and initiates approved payments without undue delay and within any processing deadline expressly retained with the Funded Account Schedule or request. Bank or network transit estimates are separate from QATS processing. QATS identifies relevant missing information and provides an expected next step and date. A valid information request does not indefinitely restart a deadline; any pause must be justified and lawful. Continuing holds receive reasons and review updates under Section 20. Mandatory deadlines prevail.
14.13Payment release is subject to authorised finance controls, secure access and a recorded transfer reference. Where an operator is also the beneficiary, a different authorised finance operator must confirm that payout. The ‘Funds sent’ status follows finance confirmation; QATS investigates a failed, returned or uncertain transfer and reconciles final delivery using available provider or bank evidence. A service provider or employee does not replace QATS as the debtor. If part of an otherwise eligible request is separable and validated, QATS pays that part where lawful and practicable even if it is below the ordinary minimum; this settles the existing claim rather than creating a new lower-minimum request.
14.14A hold is limited to what is reasonably necessary for identity or destination checks, sanctions or law, tax documentation, a credible rule issue, payment fraud, a duplicate transfer or a supported technical correction. QATS records the amount, cause, next review and release condition and provides reasons where lawful. A legal prohibition on transferring money is not automatically an extinguishment of the claim. An unsupported destination or ordinary provider delay does not cancel an approved debt.
14.15A final adverse decision identifies the affected amount, accepted rule, evidence and calculation and permits review under Section 20. QATS may remove unearned or demonstrably erroneous amounts and address proven fraud causally affecting entitlement. It must not forfeit unrelated valid Rewards for a truthful review, complaint or good-faith chargeback. A duplicate transfer may be recovered only once with an itemised legal basis; unrelated claims are not silently netted against a Reward.
14.16When a request is finally paid or otherwise resolved, the next cycle follows the accepted schedule. Earlier paid or reserved profit is not counted twice. The schedule specifies which sessions qualify in a later cycle and how any continuing trading is treated. QATS preserves a reconstructible history of cycle state, debit, reserve, release, split, fees and settlement. Termination and final eligible claims follow Section 26. Reservation, release and settlement must be reconciled consistently in daily baselines, qualifying high-water values and cycle profit under the accepted method. A release is not newly earned profit. Reconciliation includes genuine intervening trades and charges and may not restore an old snapshot as if those events had never occurred or make already paid profit available again.
14.17QATS may seek recovery of an objectively established duplicate or mistaken actual payment to the extent that the recipient was not entitled to that amount under the accepted terms and applicable law. QATS gives an itemised notice identifying the transfer, the error and the net amount sought, with meaningful review under Section 20. Any lawful setoff must concern the same legal debtor, have an identified legal basis and be disclosed in the reconciliation; it is not an automatic deduction for an unproven allegation. Returned funds, provider recoveries and offsets are counted once. Ordinary virtual trading losses are not recoverable payments. A new rule version alone does not establish an error in an earlier payment.
15Friend referrals
15.1The Friend programme is a customer discount benefit. An active trader may share the personal code or link shown on the invite page after affirmatively accepting the applicable programme provisions and displayed offer on first participation. The Friend accepts them at registration with the code; both actions are recorded under Section 1.7. The Friend must be a new eligible user with no previous purchase across any QATS identity, must not be the Inviter and must have valid attribution. A shared residence or device alone is not disqualification or proof of abuse. Participation does not create a paid affiliate relationship.
15.2The invite-page offer states its version, eligible products, discount percentages, registration and purchase windows, invitation limits if any, reward expiry and reversal treatment. QATS preserves the offer at Friend registration and the applicable order. A later offer cannot reduce a valid benefit already earned or narrow the terms of an existing recorded referral. If an offer has no expiry or invitation cap, a later limit applies only prospectively to referrals under that later offer.
15.3A valid manually entered registration code takes precedence; otherwise a code in the registration link takes precedence over an eligible stored code. First valid attribution recorded on the account is retained. Later links, codes and purchases do not automatically replace it. Corrections require documented error, invalid attribution, substantiated abuse, law or a documented customer request, with reasons and review where lawful. Partner and Friend attribution do not coexist for the same referred identity.
15.4Optional referral storage and visit counting follow the Cookies and Storage Policy. Refusal of optional attribution prevents that storage and visit counting but does not prevent use of a valid code entered at registration. On a different browser or device, reopen the valid link or enter the code. An invitation does not establish consent to tracking or direct marketing. Refusal or withdrawal of optional tracking must not be bypassed through fingerprinting, substitute identifiers or hidden tracking events for the refused purpose. Removing browser storage does not itself erase attribution already lawfully recorded on the account; any correction or detachment follows Sections 6.6 and 15.3. Browser storage does not extend the accepted registration or purchase window.
15.5The Friend discount applies to the first eligible Evaluation under the preserved offer and within its purchase window. Funded activation, resets, renewals and other services are excluded unless the relevant offer expressly includes them. Checkout shows the applicable discount and final amount. A new identity does not restore first-purchase eligibility to an existing purchaser.
15.6One Inviter reward is created when the Friend's first eligible Evaluation payment is confirmed and the amount actually paid is greater than zero. No undisclosed purchase threshold or extra validation hold applies. A free order does not create an Inviter reward. The reward is a discount on one eligible new Evaluation, with the product exclusions and expiry in the preserved offer.
15.7The oldest available Inviter reward is applied automatically to the next eligible checkout, one per purchase, and is shown before payment. Other rewards remain available. A checkout reservation that ends without payment releases the reward. Discounts apply sequentially under Section 6; percentages are not added. A partner-attributed trader may use a separately earned Inviter reward with an eligible partner discount and promotion code.
15.8Benefits cannot be withdrawn, sold, transferred, pooled into a larger discount or exchanged for cash. They are not stored money, a trading balance or a funded Reward. If QATS prevents valid redemption through its own error, it restores a reasonable opportunity to use the benefit or provides the remedy required by law.
15.9A refund or chargeback of the Friend's qualifying payment reverses the related Inviter reward under the preserved offer. An unused reward becomes unavailable; if already used, QATS records the reversal but does not charge back the discount on the Inviter's completed purchase solely because of that payment reversal. Any partial-refund adjustment must be proportionate and follow the disclosed offer. Refund of the Inviter's own purchase restores the used reward unless its underlying entitlement was separately invalidated.
15.10Refunds return the amount actually paid under Section 21, not the undiscounted list price. QATS identifies a benefit reversal, its reason category and transaction reference and notifies the affected user without disclosing another person's unnecessary information. A Friend's good-faith payment dispute is not itself misconduct by the Inviter and does not justify confiscating an unrelated funded Reward.
15.11Self-referrals, controlled false identities, fabricated customers, trading codes or benefits, spam, scraped contact lists, impersonation and false promises about funding or earnings are prohibited. Inviting does not authorise collecting a Friend's payment or identity evidence. Paid advertising, trademark bidding, coupon distribution and commission recruitment require the separately accepted Affiliate Partner Agreement and Marketing Standards; they are not authorised by a personal Friend code.
15.12Credible abuse evidence may justify a scoped benefit hold or code restriction. A final reversal or closure requires a reasoned proportionate decision and review under Section 20. Closing an account ends new invitations but does not automatically erase a confirmed benefit or statutory refund. If ordinary checkout becomes unavailable, QATS provides a reasonable redemption route or mandatory remedy; closure alone does not convert a discount into cash.
15.13The Inviter sees only the minimum status needed to administer their own benefits: pending, available, reserved, used or revoked, with a non-identifying reference where necessary. This does not grant access to the Friend's email, registration or purchase dates, purchase details, verification, trading or payout history. Before registration the Friend sees the disclosed Inviter first name and offer. QATS does not send invitations on an Inviter's behalf merely because they hold a code. The Privacy Policy governs programme data.
15.14If the Friend programme qualifies as a consumer benefits programme under section 16A (16א) of the Israeli Consumer Protection Law, QATS follows the applicable statutory advance-notice periods and redemption protections before reducing benefits or ending the programme. A general amendment or closure clause cannot shorten those periods or remove accumulated rights. Any stronger promise in the accepted offer remains binding. This programme classification is determined by its actual operation, not its name.
16Certificates and performance disclosures
16.1A certificate records only the identified account, stage, rule version, completion event and result validated by QATS. It is not a degree, professional licence, regulatory approval, guarantee of trading skill, proof of typical earnings or entitlement to live capital. Evaluation passage alone does not prove funded activation or a Reward payment.
16.2Certificates and public displays of simulation results must clearly state that the activity was simulated. A payout confirmation must distinguish a verified real contractual payment from virtual account profit and identify the relevant period and currency without exposing private destination information.
16.3You may share a genuine certificate or your own results if you preserve the simulation label and material context, do not alter verification details and do not imply endorsement or a guaranteed future outcome. QATS may correct or revoke an erroneous certificate with reasons, an audit record and review under Section 20; a change does not silently erase an otherwise valid payment obligation.
16.4QATS publishes payout totals only from reconciled payment records, distinguishes gross and net amounts and avoids counting a transfer twice. Performance claims disclose material selection and methodology limits. Identified testimonials or marketing use of your name, image or history require the permission described in Section 22. A private account screen is not public-marketing consent.
17Availability and market data incidents
17.1Market data can be delayed, corrected, fragmented or unavailable. Simulated fills can differ substantially from real execution because of queue position, liquidity, gaps, market impact, funding, fees and latency. Past or hypothetical performance does not promise a pass, a Reward or success in a real market. QATS does not guarantee uninterrupted access, including on a market that trades around the clock.
17.2QATS operates the service with reasonable care and takes proportionate steps to restore material failures. Events beyond reasonable control, including venue outages, network failures, disasters and binding government action, may delay performance while they last. QATS notifies affected users where it can. Where a material part of the service cannot be supplied for a meaningful period, section 19 decides the remedy. An outside event does not extinguish a payment already owed.
17.3An unusual market event can produce a genuine gap, and a provider error can produce a false price. QATS distinguishes them using source feeds, other venues, order times and the agreed marking method, and may briefly stop new orders while it does so. A correction is recorded as a new event and the original record is kept. QATS will not correct only the results that are unfavourable to it.
17.4A third-party chart, alert or interface may differ from QATS in symbol mapping, market, bid or ask basis, timing, spread and availability. For simulated QATS accounts, QATS acceptance and execution records and the accepted plan and Rules determine order status and fills. A chart line, webhook dispatch or browser message alone is not confirmation of acceptance, execution, protection or cancellation. A deviation control is not a guaranteed fill or a promise that every stale or incorrect price will be detected. For any separately authorised exchange service, its specific agreement and exchange records govern real executions.
18Temporary controls and investigations
18.1Where objective signs point to account takeover, a serious rule breach, payment fraud, a sanctions match or a material platform defect, QATS may pause trading, freeze a challenged pass or hold a pending payout, only as far as reasonably necessary. A temporary hold is not a final decision and is not a forfeiture. QATS records the trigger, the account and the time, and tells you the category and the next step as soon as it lawfully can.
18.2A trained reviewer examines server events, source feeds, payment records and your explanation. Sensitive verification evidence uses Section 12's secure route. An automated signal may open a case; a material adverse outcome requires human assessment. QATS identifies the accepted rule, version, relevant facts, affected transactions and outcome, with only necessary redactions. Shared devices, a profitable strategy or an automated score alone do not establish fraud.
18.3A correction covers the affected attempt and its economic effect. Where a trade is invalidated, gains and losses are recalculated consistently. QATS will not keep the favourable side and delete the unfavourable one in order to defeat a pass.
18.4A hold affecting a Reward follows Section 14. Cross-account evidence is used only where there is a genuine connection to the affected entitlement or security concern. A pending review does not become automatic denial because a target elapsed. QATS gives updates and the next review date, and preserves separable undisputed obligations.
18.5Records supporting an adverse outcome are kept for a reasonable dispute period and are intelligible to a second reviewer. Recovery of a demonstrable duplicate or mistaken payment is preserved. QATS does not impose an unpriced penalty, does not deduct an unproven allegation as if it were a debt, and does not use an unrelated dispute to erase an owed Reward.
19Errors and defective performance
19.1Report a suspected price, fill, account or service error promptly to support@qats.us with the account, the event time, the symbol and any screenshots. Do not knowingly exploit a defect. Continuing to trade after clear notice of a material defect is relevant to causation; it does not by itself waive a statutory remedy.
19.2QATS examines the reference feed, event ordering, platform state and whether the issue caused the challenged outcome. Depending on cause and severity, the remedy may be correction, restoration, removal of a wrongly recorded breach, extended access, a replacement attempt, price reduction or refund. QATS applies corrections consistently to gains, costs and losses. An alternative service remedy does not replace a monetary or other mandatory remedy to which you are entitled without your agreement.
19.3A complaint about non-delivery, billing, a failed pass, a Reward, verification or personal data needs no special form. Section 20 governs its handling. A regulator complaint or payment-provider dispute remains available. A good-faith dispute is not misconduct.
19.4A disputed rule event is answered by identifying the specific mark, floor, daily baseline, timezone and rounding, and by providing the calculation and the evidence, rather than treating the interface as conclusive. Your screenshots are read together with the server record, and QATS says when a screenshot shows stale information and why.
19.5The second reviewer is not the person who made the original adverse decision. An appeal can correct an error in either direction. It does not let QATS apply a later rule version to an earlier event. The complaint record includes the remedy given.
20Complaints appeals and decision review
20.1Contact support@qats.us or the published support route, even if portal access is unavailable. Identify the order or account if known, relevant time and timezone, event or symbol, observed result and requested remedy. Screenshots and messages may help, but you need not supply internal log identifiers held only by QATS. Security incidents and privacy requests are triaged against their own urgency and legal deadlines.
20.2QATS acknowledges a complaint, retains its receipt time and reference, identifies the next step and gives an expected response date. Any published or individually confirmed response commitment remains binding for that case; a later website change does not extend it. QATS investigates without undue delay. Mandatory deadlines take priority. A request for relevant missing evidence pauses only a justified waiting period where the law permits; information already validly held need not be supplied again. No unpublished internal appeal deadline extinguishes a claim.
20.3QATS preserves the accepted Terms, schedules, order authorisation, event sequence, timestamps, source feeds, fees, funding, risk calculations, relevant provider reports and original and corrected ledgers. It tests server integrity and timing against contemporaneous evidence; server records and screenshots are evidence, not irrebuttable truth. It explains why a challenged price, baseline, day count, floor or rounding result applies.
20.4For an allegation of intentional exploitation or fraud, a human reviewer considers reliable evidence, material causation and plausible innocent explanations. An inconclusive finding is recorded as inconclusive. Any continuing protective measure must remain necessary, scoped and reviewed. Exact security signatures and other people's data may be withheld without preventing a meaningful explanation of the allegation. For this internal review, an intentional breach is established only where the reliable evidence, including material contrary evidence, makes it more likely than not. This internal standard neither alters a court's burden of proof nor requires proof of intent for an independently validated numerical breach under Section 9.5 or an objective error correction under Section 10.7.
20.5A reasoned final notice states the account and period, applicable clause and version, evidence categories, original and corrected calculation, result and financial consequence, and how to request independent review. It is sent to the email address registered on your account or supplied by another durable means. Possible outcomes include correction, restored access, a verified pass, a supported denial, refund, payment release, partial approval or a continued lawful hold with a next review date.
20.6You may request review by replying to the decision or contacting support. A trained reviewer who did not make the original adverse decision and has no material conflict reviews the record, your explanation, causation and remedy. A later supported request is considered where reasonable, including new evidence or manifest error. An internal appeal window does not shorten a statutory limitation period or extinguish an established debt.
20.7Corrections apply favourable and unfavourable effects consistently. Where exact reconstruction is impossible, QATS explains the limit and offers a fair remedy under Section 19. Review does not authorise application of later rules to earlier activity, automatically suspend a time-sensitive legal refund or hold unrelated approved payments.
20.8QATS explains a material delay before the stated response date where practicable, gives a reason and a revised date, and provides updates while a protective hold continues. Repeated irrelevant information requests cannot restart the clock indefinitely. A missed service target does not mean automatic rejection or forfeiture and does not extend a mandatory refund or response deadline.
20.9You remain free to contact a payment provider, regulator, data authority or competent court. QATS identifies an applicable ADR body where law requires it and states any participation obligation. Internal review is not a precondition to mandatory rights or urgent relief. Truthful criticism and good-faith reporting do not justify retaliation or a confidentiality penalty.
20.10Case information follows the Privacy Policy, with limited access and lawful retention. A security or personal-data incident receives prompt containment and assessment under its applicable duties; an ordinary complaint target is not a substitute for a shorter security or notification deadline. Partner commission disputes remain governed by the review process in the Affiliate Partner Agreement and Marketing Standards.
21Cancellation refunds and chargebacks
21.1Cancellation is assessed for the specific accepted payment: Evaluation entry, reset, renewal, add-on or funded activation. Each has its own price and supplied service. Virtual account size is not refundable money; a funded Reward is a separate obligation under Section 14. A rejected order receives release of authorisation or a full refund of captured funds.
21.2Any additional voluntary unused-order cancellation offer must be expressly shown before purchase and retained with the order, including its window and starting event. No additional voluntary window is created by an undisclosed configuration. For an Evaluation offer that uses this measure, the order is unused if no simulated trade has been opened; entering the dashboard or contacting support is not use. QATS uses the recorded executions to establish first use. Opening the first simulated trade on an Evaluation ends that voluntary window automatically at the moment the platform records the trade, without notice and whatever part of the window remains; the recorded execution is the evidence of that moment. Unapplied resets and never-enabled add-ons follow their expressly offered conditions. A later offer cannot reduce a window already granted. Mandatory cancellation rights and remedies for non-delivery or defective service apply separately, whether or not a voluntary offer was made.
21.3Mandatory withdrawal and cancellation rights depend on the applicable law and the actual service. QATS supplies legally required pre-contract information, disclosure documents, notices and cancellation routes. The applicable Israeli rules are addressed in Sections 21.13 to 21.17; mandatory protections of another country remain preserved under Section 27.2. A first simulated trade is not a waiver of mandatory rights. A separately recorded request to start performance or acknowledgment of a legally permitted loss of a particular right has only the effect permitted by the applicable law. General acceptance, a digital-service label or a one-time payment does not by itself remove cancellation rights.
21.4You may cancel by a clear statement to support@qats.us identifying the service and order where available. No special legal formula is required. Where Israeli Consumer Protection Law section 14I (14ט) applies, QATS also accepts cancellation by telephone or orally at its business premises unless written notice is legally required, registered post, fax if QATS has one, and an online cancellation route for an online transaction. QATS publishes the actual contact details, required identifying particulars and a prominent dedicated cancellation link on its homepage and supplies the legally required disclosures with the transaction and receipts. Loss of portal access does not remove these routes. Verification must be proportionate and must not impose additional identity documents beyond what law permits. A durable acknowledgment is supplied; acknowledgment is not a condition for an otherwise effective notice.
21.4AWhere applicable national law implementing Article 11a of Directive 2011/83/EU requires an online withdrawal function, QATS provides a clearly labelled, prominent and easily accessible function throughout the relevant withdrawal period. It lets you identify the contract and confirm your withdrawal without unnecessary steps, and supplies a durable acknowledgment of its content and submission date and time without undue delay. Timely submission counts even if acknowledgment arrives later. This function supplements other valid cancellation routes and does not make ordinary hosted payout KYC a condition of withdrawal.
21.5A voluntary change of mind after the contractual unused window or after use, an unsuccessful attempt, ordinary permitted market loss, voluntary closure or an unrenewed paid period does not by itself create a refund. Non-delivery, misdescription, defective performance and mandatory cancellation rights are assessed separately. A repeated reset that does not restore the material paid service is not an adequate substitute for a required refund.
21.6If an activation fee was captured but QATS cannot supply usable access to the accepted service, it refunds that fee. If QATS cannot supply the promised initial funded opportunity after verified passage for its own operational reasons, or misses a binding delivery deadline, you may choose a suitable no-cost equivalent or refund of the affected Evaluation fee. Missing checks are identified promptly; routine hosted payout KYC is not retrospectively introduced as an activation condition. An Evaluation-fee refund and an independently earned Reward are assessed separately.
21.7A full refund returns the amount actually paid for the affected service, including tax where required. A partial remedy identifies the lawful calculation and remaining rights. A discount is not refunded at list value. Valid promotional credits and Inviter rewards are restored under Sections 6 and 15 where applicable; cash owed is not replaced by credit without lawful agreement. Any permitted proportionate service charge must have a legal and disclosed basis and be itemised.
21.8QATS initiates a contractual refund without undue delay and within any shorter expressly agreed deadline, measured from when entitlement arises, not an optional later approval. Statutory deadlines run from the events specified by law. The original payment means are used where possible; an unavailable method requires a secure verified alternative supported by the provider. QATS does not send a refund to an unverified third party. Provider settlement estimates are separate from QATS obligations, and any stricter legal reimbursement duty prevails. An unrelated investigation does not extend the deadline; a binding legal freeze is recorded and handled under the applicable legal requirement.
21.9QATS does not require you to close an account, waive an unrelated Reward, withdraw a truthful complaint or accept a non-disparagement promise to obtain a valid refund. An incident restoration does not require paying again for the same opportunity already purchased. Duplicate, unauthorised or post-cancellation charges are investigated and reversed where established.
21.10A good-faith chargeback is not automatic fraud. QATS may present accurate records and proportionately suspend only affected access while a reversal is investigated. A provider return is credited against the same refund obligation to prevent double recovery, with any balance still paid. Withdrawal of a payment dispute is not a blanket condition of a refund. Knowingly false payment claims may support documented proportionate action after review, not an undisclosed penalty.
21.11Refunds and chargebacks may adjust the related partner commission under the Affiliate Partner Agreement and Marketing Standards and the related Friend benefit under Section 15. They do not themselves cancel unrelated discounts, accounts or Rewards. A lawful sanctions freeze follows Section 12 and is not converted into a forfeiture for QATS's benefit.
21.12An optional cancellation statement is: "I cancel my contract for [service], ordered on [date], order reference [if known]. My name and contact email are [details]. Date: [date]." Where legally required, include your identity number through the notified secure route or other prescribed identifying particulars. QATS explains any legally necessary missing information promptly. A postal address or paper signature is required only where law requires it. Any other legally sufficient clear statement is accepted; hosted payout KYC is not a precondition to cancellation.
21.13Where the distance-selling service cancellation provisions of the Israeli Consumer Protection Law 5741-1981 apply, you may cancel within 14 calendar days after the transaction or receipt of the required disclosure document, whichever is later. For a continuing transaction, this right applies whether or not performance has started. For a service that is not a continuing transaction, the statutory right under section 14C (14ג) requires notice at least two days that are not statutory rest days before the scheduled service date. The actual transaction and statutory exceptions determine applicability; online delivery or a single upfront fee alone does not establish an exception. The separate unused-order offer in Section 21.2 and remedies for breach remain available on their own terms.
21.14Where section 14C1 (14ג1) applies, an eligible person with a disability, a person aged 65 or over, or a new immigrant within the statutory five-year period may cancel a qualifying distance transaction within four months from the applicable statutory starting event, including the later receipt of the required disclosure document. The transaction must have involved a conversation with QATS, including through electronic communication, as required by that section. Statutory conditions and exclusions apply. QATS requests only the evidence that the law permits and provides a secure route for it; eligibility does not require completing payout KYC.
21.15On a valid statutory distance-sale cancellation governed by section 14E (14ה), QATS refunds the amount lawfully due within 14 calendar days after receiving the cancellation notice, cancels the related charge and supplies confirmation. This is a reimbursement obligation, not merely a deadline to approve or initiate a refund. No cancellation fee applies to cancellation because of a defect, mismatch with disclosed terms, failure to supply on time or another breach by QATS. For another qualifying statutory cancellation, any cancellation fee must have been disclosed and must not exceed the lower of 5% of the transaction price and NIS 100, or any lower applicable legal limit. These Terms do not themselves impose that fee. No separate processing fee circumvents the limit.
21.16Where the law permits payment for a continuing service actually supplied before cancellation, QATS itemises only the lawful proportionate service charge using the accepted price and actual service supplied. Simulated losses, nominal account size, an unearned hypothetical Reward and an affiliate commission are not measures of that charge. Where that test applies to an Evaluation, QATS treats the service as supplied from the moment the first simulated trade is recorded, and calculates the lawful proportionate charge from there. The whole fee is not automatically retained because one simulated trade occurred. Any more favourable contractual refund remains available.
21.17Where section 13D (13ד) applies to cancellation of a continuing consumer transaction, the contract ends within three business days after delivery of the cancellation notice, or six business days after posting it by registered mail, unless you specify a later date. These statutory days and starting events are calculated under the applicable law, not a conflicting contractual calendar. QATS stops the cancelled service and does not charge for service supplied after the effective cancellation date. Refunds and any lawful pre-cancellation charges are assessed separately; cancellation does not erase an earned Reward or another existing payment obligation.
22Data records and intellectual property
22.1QATS owns or licenses the site, the software, the tools, the branding and the documentation, and grants you a personal, non-transferable licence to use them for the service you bought while your access is valid. You keep the rights in material you submit and grant QATS a limited licence to host, review, secure and process it in order to provide and defend the service. Public marketing use of your name, image or words needs your separate permission.
22.2QATS keeps simulation events, order histories, performance statistics and derived analytics for operation, fraud review, service improvement and lawful research, and may publish aggregate figures. Identifiable data is governed by the Privacy Policy and by law. De-identified output shared externally is protected against re-identification. Using the simulation gives you no claim to proceeds of QATS's own analysis or trading.
22.3Do not copy, sublicense, scrape at scale, redistribute protected market data, tamper with the code, or attempt to obtain source code, except where the law permits it despite a contract term. A suggestion you send may be used without payment; ownership of code you write separately needs its own agreement.
22.4You may retain accepted Terms, schedules, confirmations and invoices and request relevant account records, timestamps and calculations under Section 20 and applicable law. This does not authorise bulk redistribution of protected third-party data. A lawful dispute-preservation duty may require retention despite ordinary deletion schedules.
22.5Open-source components, data feeds and chart libraries remain subject to their applicable licences and owners' rights. QATS makes any terms that govern your permitted use available where required. Third-party terms do not silently reduce QATS's obligations for the service you bought or exclude mandatory rights.
22.6QATS may analyse recorded trading events to operate the service, conduct lawful risk research and support its own independent decisions. This does not transfer ownership of your strategy or code or authorise external sale of identified trading history. Strategy documents or source code supplied only for support are used only for that support, investigation and security purpose unless separately agreed or required by law. Disclosure of identifiable data needs a lawful basis and the applicable Privacy Policy notice. Aggregate or de-identified use remains subject to Section 22.2.
22.7You must protect non-public API secrets, security credentials, source code and fraud-control information lawfully disclosed in confidence. QATS protects your confidential support, identity and payment information under these Terms, the Privacy Policy and law. This does not restrict disclosure of your own agreement or relevant records to advisers, payment providers, regulators or courts, a legally protected disclosure or a truthful complaint or review. Public information and information independently obtained without breach are not made confidential by this provision.
22.8TradingView is a trademark of TradingView, Inc. QATS is not affiliated with or endorsed by TradingView. Other third-party names and marks belong to their respective owners and are used descriptively. No reference, connection or chart display implies sponsorship, approval or a grant of rights in a provider’s site, software or market data. Required attribution must remain visible.
23Communications and user content
23.1Support communications must not threaten, harass or expose another person's private information. Honest criticism, truthful reviews, protected speech, a complaint to a payment provider or a regulator, and evidence given to a lawyer are permitted. QATS will not require a non-disparagement promise as a condition of a refund.
23.2QATS may ask you to redact live credentials, provider keys and another person's personal data from a public screenshot.
23.3If QATS offers a community feature, public profile, leaderboard or sharing within its tools, it provides the applicable visibility settings, content standards and a route to contest removal. Simulated performance displayed anywhere does not establish an owed Reward or a typical outcome. Public marketing use remains subject to section 22.1.
24Liability and indemnity
24.1So far as the law allows, neither party is liable for remote or unforeseeable consequential loss, including speculative profits from a real trade you made elsewhere. QATS remains responsible for proven direct loss caused by its breach of the service you bought, for refunds properly due, for a Reward owed under the funded and payout provisions in Sections 13 and 14, and for liabilities that cannot lawfully be excluded. QATS does not promise a trading result and does not warrant third-party market data as investment grade.
24.2Subject to mandatory law, QATS's aggregate liability for other damages attributable to a particular trading account is limited to the greater of USD 1,000 and the fees paid or owed for that account and its related Evaluation and activation in the twelve months preceding the event. For a claim not attributable to a trading account, the corresponding limit is the greater of USD 1,000 and fees paid or owed under these Terms in that period. Connected claims for the same account and event share the applicable cap; the same loss is not recovered twice. No cap reduces a valid refund, an earned or approved Reward or another established payment obligation. Nothing excludes fraud, fraudulent misrepresentation, deliberate wrongdoing, death or bodily injury for which QATS is liable by law or liability that cannot lawfully be limited. Every exclusion, cap and indemnity is subject to the Israeli Standard Contracts Law 5743-1982 where applicable, including judicial control of unfair terms, and to other mandatory protections. No provision restricts access to a competent court or limits liability for a malicious act. Acceptance does not establish that a limitation is fair or individually negotiated.
24.3An objectively valid Reward claim is assessed under Section 14 even before final approval; the liability cap cannot make its value zero. A platform defect is assessed under Sections 19 and 21. QATS does not promise a trading outcome or compensate every unearned hypothetical simulated gain, but remains responsible for its contractual service and mandatory remedies.
24.4If you contract in the course of a business, you indemnify QATS against reasonable third-party claims and defence costs caused by your intentional unlawful conduct, infringement in material you supplied or material unauthorised intrusion. This does not apply to a Consumer, QATS's own fault or ordinary permitted simulated trading. QATS gives prompt notice, permits reasonable control of the defence, cooperates and takes reasonable steps to limit costs. A settlement admitting liability or imposing a non-monetary obligation on the other party requires that party's written consent, not unreasonably withheld. Only losses attributable to the covered conduct may be recovered, without double recovery.
24.5Each party takes reasonable steps to limit avoidable loss, without having to incur unreasonable cost or give up a legal right.
25Changes and preservation of accepted terms
25.1QATS may add, rename, withdraw or revise future offers, plans, prices and promotions. Published versions have effective times and remain retrievable. A change to a separately published schedule does not require replacing the text of these Terms if their substantive rules remain unchanged; it still requires the relevant disclosure and acceptance and preservation of prior transactions.
25.2For an existing order, activated funded account, recorded referral or case, the accepted versions and applicable parameters continue to govern. A newly published Terms version does not retrospectively replace them. A narrowly necessary change for law, sanctions, serious security risk or a material defect may take effect sooner only to the extent needed, with reasons, notice where feasible and a fair remedy for material loss of the purchased service. A commercial change is not a legal emergency.
25.3Material proposed changes are notified by email or another durable means with their scope, effective date and the rights affected. QATS obtains fresh acceptance where needed, including at a later stage governed by new terms, while preserving accrued rights. Routine navigation or sign-in is not acceptance of an adverse change to existing paid terms. QATS must not condition payment of an existing debt on surrendering rights under its original version.
25.4The registry links each published version to its immutable text and acceptance evidence. Corrections are issued as new versions where the text changes; earlier accepted records remain available. A later version does not reopen a completed Evaluation, cancel an earned Reward or narrow an existing refund solely because wording changed.
25.5If a provider stops supporting an instrument or a country without warning, a protective halt may come before notice. QATS then records whether a suitable alternative preserves what you bought, and provides a remedy if the change substantially deprives you of the paid service.
26Suspension termination and final settlement
26.1The relevant provisions of these Terms apply while you use the site or hold an account. A paid Evaluation starts under section 1.4 and ends when the attempt is verified as passed or failed, is lawfully cancelled, or is otherwise terminated under these Terms and its plan. A monthly service also depends on its paid period. A pending review does not erase the protection in section 7.6.
26.2You may ask us to close your account and may exercise a statutory or contractual cancellation under the cancellation and refund provisions in Section 21. Your closure instruction is recorded with its scope: stop renewing, cancel one unused order, or close the identity. A request to stop marketing is not a request to close an account.
26.3QATS may end access for a material uncured breach after reasonable notice where a cure is possible, and immediately for documented serious fraud, a legal or sanctions restriction, serious security harm or materially unlawful use. Loss of eligibility may require ending the affected service, but lawful earlier use is not misconduct. QATS gives reasons where lawful, preserves review rights and determines refunds and other remedies under these Terms and mandatory law.
26.4For business or capacity reasons, QATS gives reasonable advance notice before ending usable paid access and honours any longer notice period expressly agreed for that service, unless law or an urgent security need requires earlier action. If an Evaluation cannot be supplied substantially as agreed, QATS offers an equivalent replacement for your acceptance or refunds the affected fee. Funded closure follows the final-claim process below. Convenience termination must not be relabelled as misconduct.
26.5On termination new activity ends and open simulated positions are closed using the accepted method. QATS supplies a final statement distinguishing virtual balances, prior Reward debits, pending claims, approved unpaid debts and any disputed amount. Virtual balances do not become payable merely because the account closes. Closing portal access does not prevent submitting or pursuing an existing claim.
26.6Provisions on payment and refunds, intellectual property, personal data, disputes and accrued obligations survive as long as needed. QATS keeps records required for a legal duty or a good-faith claim, in line with the Privacy Policy.
26.7If QATS closes for convenience, or a QATS-imposed closure or interface failure prevents submission, you may present a final Reward claim where all objective eligibility conditions were met immediately before that event. Any expressly agreed internal submission period runs from delivery of the final account statement; without such a period, QATS does not impose an unpublished contractual cutoff. QATS uses the eligible pre-closure or pre-failure state and does not manufacture a later breach through its own closing process. Closure does not waive the accepted qualifying-day, minimum, cap or risk conditions. The internal period does not shorten a statutory limitation or permit avoidance of a valid claim, and delay in supplying the statement cannot shorten your submission period.
26.8On voluntary closure, inactivity under a disclosed rule or a supported hard breach, an earlier properly submitted claim remains assessable on its own facts. Unrequested virtual profit not yet qualifying as a claim is not automatically cash. A finding on one account does not erase unrelated valid claims. Only demonstrated erroneous or tainted effects are removed, with a reasoned calculation and review.
26.9Final settlement reconciles prior transfers, validates pending and approved claims, removes only legally supported erroneous amounts, applies required withholding and itemised lawful setoff, pays separable undisputed sums and retains only amounts subject to a genuine legal hold. A fee refund for non-delivery is assessed separately. An approved debt is not extinguished by an unavailable payment rail or a routine verification delay.
26.10Inactivity may cause suspension or closure only under the measure and period disclosed in the accepted account schedule. The system measures the recorded last qualifying execution or applicable account-start event against calendar time and sends a warning before closure where configured. A login or an unfilled order does not restart that clock. No unpublished inactivity threshold causes forfeiture. If a material platform outage or wrongly blocked access prevented qualifying activity, you may challenge the closure under Section 20; QATS reviews the evidence and applies any correction or remedy required by Section 19 or law. Closure does not itself extinguish an established Reward or other payment claim.
27Governing law disputes and notices
27.1Before going to court, the parties will try to resolve the matter in writing through support@qats.us, identifying the order, the event and the outcome sought. This does not prevent urgent court relief, a payment dispute, a complaint to a regulator or a statutory consumer claim, and is not a precondition to any of them.
27.2These Terms and disputes arising out of or relating to them are governed by the laws of the State of Israel. For a party acting in a business capacity, the competent courts in Tel Aviv-Yafo, Israel have exclusive jurisdiction, only to the extent that this agreement on jurisdiction is valid and enforceable. For a Consumer, those courts are an agreed non-exclusive forum, without restricting any other court available under applicable consumer or mandatory jurisdiction rules. Nothing overrides subject-matter jurisdiction, applicable protections under the Israeli Standard Contracts Law, or a mandatory right of either party to bring or defend proceedings elsewhere. The choice of Israeli law does not deprive a Consumer of protections that cannot lawfully be excluded under the law otherwise applicable to that Consumer. Complaints to regulators and payment providers remain available.
27.3These Terms contain no compulsory arbitration agreement or class-action waiver. The choice of law and courts in section 27.2 is subject to mandatory rights. Merely visiting the public site does not create a paid Evaluation order.
27.4Contractual notices to QATS may be sent to support@qats.us or the registered and notice address stated above. Mandatory legal service rules remain unaffected. QATS sends material decisions to the email address registered on your account or by another durable means and retains delivery evidence where available. Keep your contact details current. If QATS knows delivery failed, it takes reasonable steps to use another available channel; a silent webpage edit is not notice.
27.5English is the language of these documents. Where mandatory law requires a notice in a local language, that notice prevails to the extent the law requires.
27.6QATS may transfer this agreement as part of a genuine business transfer, with notice and with its obligations assumed, and cannot reduce your existing rights by doing so. You may not transfer your access or sell an Evaluation without QATS's written consent. QATS may use service providers without transferring its own responsibility.
27.7If a provision is unenforceable the rest continues, provided the bargain still works. A delay in enforcing a right does not waive it. The parties act independently; this agreement alone does not create agency, employment or fiduciary authority. Mandatory classification follows the actual relationship and applicable law, consistently with Section 13.6. Electronic acceptance and records are valid where the law allows.
28Definitions
28.1Account means your personal trader identity. Trading Account means a particular Evaluation or funded instance. Attempt means one purchased or validly reset Evaluation. A Step is a phase of a multi-step Evaluation. One identity may hold the number of trading accounts permitted by its accepted schedule.
28.2Plan card means the versioned published offer specifying the selected plan. Rules means the applicable Evaluation and Trading Rules. Snapshot means the retained accepted parameters and measurement rules for the order or account. A Funded Account Schedule records the complete funded offer accepted at activation. A published schedule is incorporated only for its identified subject and version.
28.3Account size or Starting Balance means a nominal virtual measuring balance. Balance means the simulated ledger after closed results, costs and adjustments. Equity includes unrealised simulated profit and loss. Floor means the applicable maximum-loss threshold, including any disclosed trailing or payout-related rule. Retained profit and cycle profit use the distinct bases identified in the account schedule; they are not interchangeable labels.
28.4Risk Day or session means the dated market session and timezone in the accepted Rules. A qualifying or Winning Day has the measurement, threshold and period in the accepted account schedule. A hard breach has the disclosed final consequence; a session pause or personal stop does not become a hard breach merely because it blocks new entries.
28.5Reward means a contractual funded performance payment under Section 14. Gross request means the performance amount before the company split. Trader amount before fees means the trader share after rounding. Net remittance means the amount after applicable disclosed fees, withholding and conversion. Account debit means the separately disclosed simulated deduction. An Inviter reward is a purchase discount under Section 15 and is not a funded Reward.
28.6Consumer means a person entitled to consumer protection under the applicable law, including a purchaser of a service for mainly personal, domestic or family use where the Israeli Consumer Protection Law applies. A trader label, a performance-payment opportunity or acceptance of these Terms does not conclusively determine that status. Business Day means Sunday to Thursday excluding official public holidays in Israel, using the Asia/Jerusalem time zone. Mandatory deadlines and legal counting rules take precedence; other days are calendar days unless trading sessions are expressly identified. A new calendar does not extend a deadline already promised under an earlier accepted version. This definition governs contractual support, payment and cancellation periods; trading sessions follow the separate Chicago or UTC convention in the accepted Rules.
28.7Including introduces examples without removing an express limit. A discretion stated as may is exercised reasonably and in good faith. Will imposes an obligation. Amounts are denominated in the disclosed currency. Headings support navigation and do not change operative provisions.
Annex ARecorded parameters and publication sources
The following records form part of the relevant accepted transaction. A missing material parameter must be completed and displayed before the transaction is accepted. Annex BShort simulation disclosure
The following summary accompanies the relevant purchase and activation screens. It does not replace the full Terms or waive mandatory rights.
Evaluation and initial funded trading are simulated; the displayed account size is not your deposit or money held for you.
Your fee buys the selected service, and an unsuccessful attempt can result in loss of that fee.
Simulated fills and performance can differ materially from real trading because of liquidity, costs, gaps and latency.
Passing does not guarantee live capital or income. A real performance Reward requires an activated funded account and the accepted payout conditions.
Identity and destination verification are required before Reward payment; ordinary hosted KYC is not a purchase or initial activation prerequisite.
Read the recorded plan, funded payout parameters and cancellation terms before committing. This acknowledgment does not waive a valid refund, Reward or mandatory protection.
